（中央社記者戴雅真台北30日電）行政院會今天排定通過勞動部擬具的勞動基準法部分條文修正草案，送立法案審議。內容包括取消7天國定假日、採「一例一休」，勞團上午聚集在行政院外抗議，並與警方發生推擠。

團結工聯、台灣高等教育產業工會等團體約莫百人聚集在行政院大門口，高舉標語，要求全國一致國定假日19日，年休123天不退讓。

勞團要求另包括，廢除所有變形工時及責任制相關法條。

勞團表示，「一例一休」可能導致基層勞工「看得到」卻「吃不到」，因為許多企業通常以「加班換休」方式規避給付加班費，而勞動部歷來解釋這是合法，並說補修標準由勞雇雙方自行協商，所以雇主還是可以任意調移工作日與休息日，勞工領不到加班費，週休二日仍不會達成。

勞團主張，若要採取「一例一休」，雇主要求勞工於休息日出勤，應該嚴禁「加班換休」，並且除了當天加給工資，還要還給勞工休息，事後7日內應補休1日，否則「以價制量」促進週休二日根本只是空話。

勞團另指出，既然法定工時已經縮短為40小時，沒有零碎工時的存在，勞基法所有變形工時規定應該要配套刪除，但修正草案中卻沒有刪除。且從華航罷工可看出，勞基法第84之1的責任制，也是讓勞工工時過長、工作過勞的凶手之一，同時主張配套刪除。1050630
